Terms and Conditions

TERMS AND CONDITIONS AND AGREEMENT between Hot Goanna Pty Ltd, "Kay House" Suite 1A, Level 4 35-39 Scarborough St Southport QLD 4215, Australia, AND THE CUSTOMER (customer).

The applicant wishes to procure Online Marketing services from Hot Goanna. These Terms and Conditions cover the following Hot Goanna services: PPC, SEO, SEM Support and Landing Pages.

PPC (Pay Per Click) 3 Month Agreement

This initial agreement is for a consecutive period of 3 months ("minimum term") except where otherwise agreed, and will continue until, either the customer cancels the service online via the online management system (OMS), advises in writing, or by email to support@hotgoanna.com.au that the services are no longer required.

Such notice will be conditional on all accounts being paid in full, otherwise this agreement and contract will continue from month to month. During the minimum term the service cannot be paused or suspended. The custmer may cancel within the minimum term via the Online Management System (OMS) on payment of an early cancellation fee of $330 inclusive on GST.

Should the customer not wish to continue the service after the minimum term has passed, notice needs to be given at least one business day before the end of the current monthly billing cycle, otherwise this agreement will continue from month to month.
When a customer cancels their service after the minimum term has passed, no refunds will be provided for any outstanding days or Adspend that remains for the remaining part of the current monthly billing cycle. The monthly billing cycle starts on the 15th of every month and ends on the 14th of the next month.

Instructions in relation to the operation of the Online Marketing services, from the customer to Hot Goanna will be by way of email to support@hotgoanna.com.au and no voice based permission system will form an amendment, alteration, direction or consent in any matter.

Hot Goanna will provide the web marketing services to the customer outlined and agreed to on the Agreement of Services form. Upon signing the Agreement of Services form, the customer, whose details form part of this Agreement, agrees with these Terms and the Conditions of use of any service offered by Hot Goanna.

The customer authorizse their credit card to be debited with monthly Account Management Fees, and Advertising Costs each month (in advance). The customer authorizes Hot Goanna to debit their credit card with such account charges and fees as are due and payable at that time, using this as authority until the agreed service is cancelled.

PPC (Pay Per Click) Month by Month Agreement

This initial agreement is for a period of one month except where otherwise agreed, and will continue until, either you the customer advises, in writing, or by email to support@hotgoanna.com.au that the services are no longer required.

"One month" is the time from the date of commencing the service to the anniversary date. Should the customer not wish to continue the service, notice needs to be given at least one business day before the end of the billing period.

Example: The service has been ordered on June 1, and the campaign goes live on June 5. In this case, the customer will be billed from June 5 until July 4. Should the customer not wish to continue the service, notice needs to be given on July 3 the latest; earlier if July 3 is not a business day (Monday - Friday).

Such notice will be conditional on all accounts being paid in full, and that a minimum of 1 business day notice in advance of such termination shall be given, otherwise this agreement will continue from month to month.

No refunds will be given for services that are being cancelled mid-month.

Lead Generation Pages

When a lead generation page is ordered by the applicant, Hot Goanna will host the lead generation page, free of cost, on behalf of the applicant. Lead generation pages are only available in conjunction with the order of a PPC (Pay Per Click) service and remain the property of Hot Goanna.

If the applicant has an existing domain name registered with TPP Internet and wants to use this domain as the name for the lead generation page, we will install URL forwarding from the applicants' URL to the landing page at no cost. The lead generation page will be removed if the applicant cancels the PPC service.

PREMIUM SEO (Search Engine Optimisation)

Ranking guarantees only apply to the following Hot Goanna SEO packages:

SEO-Bronze
SEO-Silver
SEO-Gold
SEO-Platinum

All ranking guarantees with respect to the above packages, as specified on the Hot Goanna website (www.Hot Goanna.com.au), are based on a minimum continuous service term of 6 months.

Any guarantees and product claims only apply if all suggested optimization changes are implemented correctly (as determined by Hot Goanna) on the web pages associated with the service as agreed upon at the time of order. If any changes are made to the proposed keywords, content, meta tag or any other modification delivered by Hot Goanna as part of the SEO packages, this will impact the ability to deliver the specified rankings and will therefore void all ranking guarantees.

Websites which fail to comply with the following guidelines are excluded from any ranking guarantees with respect to the SEO packages:

Where the submitted site is not the destination URL including 301, 302 and DNS redirects.
Without content which can be readily indexed by a search engine, including but not limited to sites which contain only images or flash content.
That rely heavily on content or links to content created for another web site, such as affiliate content.
Which result in a 404 error.
Which are secure such as https pages
Where the “robots.txt” file is set-up in a manner which disallows crawling by search engine spiders and web robots.
Where the website's content is predominantly a duplicated version of content found on other website/s.
If the website contravenes any other listing and SPAM guidelines as outlined by Google and/or Yahoo! and/or MSN.
Websites which promote pharmaceutical, casino, gambling or adult content are also excluded from the ranking guarantee unless specified otherwise.

Please contact us if you are unsure about any of the above exclusions. If a website meets all of the above criteria and Hot Goanna fail to deliver the specified ranking commitment after 6 months of continuous successful service, Hot Goanna will continue optimizing the website at no further cost until the specified rankings are achieved. Once the ranking commitments are met, monthly billing will continue as per normal. Any rulings on the above terms made by Hot Goanna are final.

I / we acknowledge acceptance of these terms and conditions as amended from time to time.

Online Marketing Campaign Success Guarantee

Our Online Marketing Success Garantee only applies to the following fully managed Hot Goanna Pay Per Click (PPC) Services

PPC-Advanced (3 Month Campaign)
PPC-Premium (3 Month Campaign)

All success guarantees with respect to the above packages, as specified on the Hot Goanna website (www.Hot Goanna.com.au), are based on a minimum continuous service term of 3 months.

Any guarantees and product claims only apply if Google or Yahoo! Conversion Tracking codes are implemented correctly (as determined by Hot Goanna) on the web pages associated with the service as agreed upon at the time of order. If any changes are made to the conversion tracking codes or any other modification delivered by Hot Goanna as part of the PPC services, this will impact the ability to track sales or leads generated by Hot Goanna and will therefore void all success guarantees.

By guaranteeing to generate sales or leads for you business during the 3 months the agreed service runs means Hot Goanna will generate at least two sales or lead enquiries (conversions) from your website that is tracked by our conversion tracking and visible in your Online Marketing Campaign reports, or a phone call directly to your business phone number displayed on your website. If Hot Goanna fails to deliver on these conversions at the end of 3 months, Hot Goanna will continue to run your Online Marketing Campaign at no further cost until the conversions are generated.

Hot Goanna reserves the right to build a dedicated marketing Landing Page, at no cost, to assist in generating conversions for the agreed service if required.
